Article 1 — Purpose
These General Terms and Conditions of Sale (T&Cs) govern the contractual relationship between ILÀRA SAS, a company with a share capital of €10,000, registered with the Paris Trade and Companies Registry under number 123 456 789, with its registered office at 12 rue des Plantes, 75011 Paris (hereinafter "ILÀRA"), and any natural or legal person wishing to make a purchase via the website ilara-tea.com (hereinafter "the Customer").
Any order implies unconditional acceptance of these T&Cs. These conditions prevail over any other document from the Customer.
Article 2 — Products
The products offered for sale are those listed on the website at the time of consultation by the Customer. Each product is accompanied by a description indicating its essential characteristics. The photographs illustrating the products are not part of the contractual scope.
ILÀRA reserves the right to modify its product range at any time. In the event that an ordered product is unavailable, the Customer will be informed as soon as possible and may either cancel their order or accept a substitute product of equivalent value.
Article 3 — Prices
Prices are stated in euros inclusive of all taxes (VAT included), excluding delivery costs. ILÀRA reserves the right to modify its prices at any time, it being understood that the price applied is the one in force at the time of order validation.
Delivery costs are indicated at the time of basket validation and vary according to the chosen delivery method. Standard delivery is free for any order of €60 or more.
Article 4 — Orders
The Customer places an order by selecting products in their basket and validating the various steps of the online ordering process. The order is considered final after payment confirmation. A summary confirmation email is sent to the Customer.
ILÀRA reserves the right to cancel any order in the event of suspected fraud, manifest price error, or prolonged product unavailability.
Article 5 — Payment
Payment is made online by credit card (Visa, Mastercard, American Express) via our secure payment provider Stripe. Transactions are secured by an SSL encryption system. ILÀRA stores no banking data.
In the event of payment refusal, the order is automatically cancelled and the Customer is informed by email.
Article 6 — Delivery
Products are delivered to the address indicated at the time of the order. Indicative timescales are 3 to 5 business days for standard delivery and 1 to 2 business days for express. These timescales run from the date of dispatch, confirmed by email.
In the event of a dispatch delay of more than 7 business days (excluding force majeure), the Customer may cancel their order. ILÀRA cannot be held responsible for delays attributable to the carrier.
Article 7 — Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision or pay any penalty.
This right does not apply to food products likely to deteriorate or expire quickly, nor to unsealed products that cannot be returned for hygiene reasons.
To exercise this right, the Customer must notify ILÀRA of their decision via the withdrawal form available in their account space or by email at contact@ilara-tea.com.
Article 8 — Warranties
Products benefit from the legal guarantee of conformity (Articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).
Article 9 — Personal Data
ILÀRA processes the Customer's personal data in accordance with its Privacy Policy. The data collected is necessary for order processing and is never sold to third parties.
Article 10 — Disputes
In the event of a dispute, the Customer may seek an amicable resolution by contacting ILÀRA's customer service. Failing this, the competent courts are those of the jurisdiction of ILÀRA's registered office, unless otherwise required by law.
The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
